Well, there is more info out now on the track that is getting sued by the injured rider. According, to the court documents there is a man from Kansas that is suing the owner of Guthrie MX Raceway for an amount in excess of $10,000.00. The documents state that on March 14, 2009 the plaintiff and others were riding on the defendant's track when a younger rider riding a motorcycle he could not control crossed over the center of the track into the riders traveling in the opposite direction and collided with the plaintiff Shane Simon.
It also claims that the track owner was negligent in allowing the younger rider to ride on the track and that there was negligence in his design and supervision of the track and its use, including but not limited to, failing to place bails of hay or other bumpers or dividers to prevent such collisions.
